On Wednesday, the Massachusetts Appeals Court ruled that the Boston College Police Department (BCPD) was acting legally when a search was performed on a dorm room, where allegedly found were “cocaine, marijuana and hallucinogenic mushrooms while responding to a report of a weapon,” according to the Associated Press.
The search had occurred in 2007 and resulted in two students facing drug trafficking and possession charges. A lower court judge had granted the students’ request to suppress the drugs found, but the most recent court ruling has overturned this.
The Appeals Court stated that based on Boston College’s on-campus residence policy, weapons are prohibited, which gave BCPD the right to enter the room and do a “plain view search.” According to the court, the students later gave permission to BCPD for the second search during which they discovered the drugs.
